A federal judge in Florida has paused a long-running lawsuit over whether medical marijuana patients can be barred from owning firearms.
The pause is due to a pending U.S. Supreme Court case that centers on the same federal law. District Judge Allen Winsor issued the stay, halting the Florida case until the Supreme Court rules in United States v. Hemani, a Texas case.
The Texas case will test whether a law prohibiting “unlawful users” of controlled substances from possessing guns violates the Second Amendment.
the Supreme Court’s decision in Hemani will “almost certainly have a significant impact” on the Florida case.
