Queens Robbery Case Overturned

An appeals court overturned the conviction of a Queens man after judges ruled that police officers improperly frisked the man who led them on a high-speed car chase.

A Queens man, Shawn Lewis, 27, who was found guilty of robbery in 2019, had his conviction vacated after an appeal decision found the arresting officers committed an unconstitutional search and seizure.

The Appellate Division, Second Department, ordered a new trial to be held in the case, citing the violation of Lewis' Fourth Amendment rights during the arrest.

The issue arose when officers searched Lewis' pockets for the allegedly stolen wallet and found it, rather than from the pursuit or detention itself.

The appeals court said police officers violated his Fourth Amendment rights during the arrest.

The case will now undergo a new trial.
